Domestic Violence & Injunctions

As many as 1 in 4 women will suffer domestic violence at some point in their lives. It can affect men as well and it always affects any children involved in the relationship.

Domestic violence is a wide ranging term and is often used to describe the following:

  • Physical abuse – hitting, slapping, pushing, kicking.
  • Sexual abuse – forcing you to do sexual things that you don’t want to do.
  • Verbal abuse – where your boyfriend or partner yells at you, puts you down or calls you names.
  • Emotional abuse – speaking in ways which are frightening or threatening.
  • Financial abuse – refusing to involve you in financial decision making.
  • Spiritual abuse – stopping you from practicing the religion of your choice.
  • Social isolation abuse – controlling what you do, whom you talk to, where you go.

There are two types of injunction order which can be sought to protect you:

•           A Non-Molestation order

This protects you from the threat or use of violence and the use of intimidation, harassment or pestering. When making such an order, the court can take into account all relevant circumstances.

•           An Occupation order

The court can order this if there is significant risk of harm to you and/or your children. The order may demand that your partner/spouse leave home, deny them the right to occupy the home and exclude them from a defined area around the home.
