Since 1st October 2007 it has not been possible to execute a valid Enduring Power of Attorney as they were replaced by Lasting Powers of Attorney. However, any existing Enduring Powers of Attorney continue to be valid if they were made before 1st October 2007.
An Enduring Power of Attorney is a legal document whereby it was possible to nominate other to look after your property and financial affairs if you were not able to do so yourself.
If the person who signed the Enduring Power of Attorney, the donor, is no longer able to manage their own affairs then the attorneys are under a duty to register the Enduring Power of Attorney with the Office of the Public Guardian.
