Lasting Powers of Attorney

Lasting Powers of Attorney are legal documents that empower you to appoint those whom you would want to look after you affairs if you were unable to do so yourself. They were introduced in October 2007 in line with the Mental Capacity Act 2005.

They are primarily aimed at covering situations when an individual is deemed to have lost mental capacity and can no longer manage their own affairs. Once properly signed and executed, a Lasting Power of Attorney cannot be used until it has been registered with the Office of the Public Guardian.

There are two types of Lasting Power of Attorney:

Property and Financial Affairs – These allow those who you would wish to make decisions concerning your property and other financial matters.

Health and Welfare – These allow those who you would wish to make decisions concerning your health and welfare, including make decisions on your behalf in relation to life sustaining treatment.

You can make one type of power of attorney without making the other; however we would normally recommend that both are made to ensure both areas are covered, if appropriate.
