What is a contentious will?

In some cases, disputes can arise over the contents of a Will or the administration of an estate; these matters are sometimes referred to as ‘Contentious Probate’ matters. 

In such a scenario, it is important to find trusted legal help to help navigate the Will dispute in the best way possible, whether you are the executor of the Will that is being challenged, or an individual looking to dispute the will yourself.

What issues can lead to a Will dispute?

There are are a variety of different scenarios that could lead to a contentious will situation, with disputes concerning a Will or an estate including issues such as:

  • Capacity – did the person who made the will have capacity to make a Will?
  • Inheritance (Provision for Family and Dependants) Act 1975 claims – was everybody who should have been provided for included in the Will?
  • Challenges to the appointment of Executors
  • Obtaining accounts from Executors/Administrators

Our experience with will disputes
