Advising the Elderly and the Mentally Infirm
An elderly client has their own special needs from a solicitor.
They often require specialist advice concerning their finances, especially if they need care in their own home or are to go into a Nursing Home.
Clients who have become mentally incapacitated, and have not previously appointed an Attorney to look after their affairs before they became incapacitated, also need specialist help. In those circumstances The Court of Protection can become involved and a Receiver needs to be appointed to administer the patient's affairs properly, and pay bills and Nursing Home fees. This is a costly and slow process and can be avoided with foresight.
Clients also often wish to make provision in their lifetime for other family members. But making gifts, or transferring property, can have major implications for tax, funding by Social Services and state benefits, as well as for the individual client, and therefore it is always a good idea to take professional advice.
