Accident Claims – Your Questions Answered
Why Dickinson Parker Hill?
We are a well respected firm of solicitors with a great deal of experience in handling both small and complex injury claims. We can offer you a fast, friendly and free service. Clients often come to us after they have been disappointed by the panel solicitors forced upon them by their insurance company – you can choose who you want to represent you!
Do I have a claim?
If you are not sure whether you can make a claim, give us a call and discuss your accident with us confidentially and without obligation. We will be able to advise you whether your claim can be pursued.
How much will the claim cost me?
We provide a "no win, no fee" service. When we win your case, we recover your legal fees from the other side, as they are obliged to pay these in addition to your compensation. You receive 100% of your compensation. If your claim is unsuccessful, a policy of insurance will pay the other side's costs. You will not be asked to fund that policy.
My accident happened a while ago, can I still claim?
Normally you have three years from the date of injury to make a claim. This rule does not apply to children as the three years does not start until their 18th birthday.
What can I claim for?
In addition to compensation for your injury, you can also claim for any losses caused by the accident, such as lost earnings, treatment costs, taxi fares, damage to clothing or personal belongings and even the cost of care provided to you by family and friends.
Do I have to attend your office, does it matter where I live?
No. You are welcome to drop in and see us, but we are normally able to deal with claims over the telephone and by post. In addition to our many local clients, we act for clients all over the country.
How much compensation will I receive?
The amount of compensation is completely dependent upon the medical report we will obtain on your injuries, therefore we cannot initially predict the amount you will receive at the start of your claim. At the appropriate time, we will arrange an examination with an independent doctor so that he can prepare a report on your injuries. This is how we will determine the value of your claim. The examination will take place locally and you can include the cost of the travelling to the examination as part of your claim.
How long will my claim take to settle?
Unfortunately, there is no simple answer to this question, as it will vary from case to case. A simple car accident can be settled within a matter of months, though if you have suffered serious injuries, it may take longer. We must be sure that the medical evidence is clear on your recovery so that we can properly assess the compensation you are entitled to. We will be in a better position to anticipate how long your claim will take as the case progresses. You can be assured that your claim will be dealt with without any unnecessary delay.
Will I have to go to court?
The vast majority of claims of claims settle before court proceedings need to be issued. Even once court proceedings have been issued, there is still a high probability that the case will settle before attendance at court becomes necessary. However, in a small number of claims, court attendance may be necessary.
